1. Website Presentation

1. Please read this document carefully. It contains very important Information regarding your rights and obligations, including limitations and exclusions that might apply to you.

2. These terms of service apply to the purchase and sale of products through NINE-FIFTEEN.NET. These terms of service, are accepted by you, by placing an order with us. These terms of service are an integral part of the website and apply generally to the use of NINE-FIFTEEN.NET.

3. These terms and conditions are subject to change by NINE FIFTEEN, without prior written notice at any time, in our sole discretion. The latest version of the terms of service will be posted on NINE-FIFTEEN.NET, and you should review these terms of service prior to purchasing any product.

2. Business Policy

1. NINE FIFTEEN offers products for sale on NINE-FIFTEEN.NET, and its e-commerce business services are available exclusively to its end users, known hereafter as Consumers.

2. A “Consumer” is defined as any individual who enters into a purchase contract, for purposes other than pursuing his or her own trade, business, or independent profession. If you are not a Consumer, please do not purchase products from NINE-FIFTEEN.NET. 

3. NINE FIFTEEN reserves the right, to refuse to process orders received from users who are not Consumers; as well as any other order which does not comply with the business policies of NINE FIFTEEN. 

4. These General Terms of service of Sale exclusively regulate the offer, transfer and acceptance of purchase orders for products sold by NINE FIFTEEN for users of NINE-FIFTEEN.NET.

3. Products and Pricing

1. In the case of MADE-TO-ORDER items, we will retain the amount from your credit card / debit card / PayPal account as soon as you place the order.

2. Please be aware that because of the MADE-TO-ORDER nature of such transactions, you should expect a wait period of approximately Four to five ( 4-5 ) weeks between the date you place your order and the date that the product is ready for shipment. Please note: Our offices close during the month of August. This may affect the shipping time of your order.

3. We attempt to be as accurate as possible with product descriptions. In the event that a product is listed with incorrect information due to typographical error or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for products listed. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card / debit card / PayPal has been charged. If your credit card / debit card / PayPal has already been charged for the purchase and your order is canceled by NINE FIFTEEN, we shall immediately issue a refund to your credit card / debit card / PayPal account in the amount of the charge and advise you of the canceled order. If you are not completely satisfied with your purchase, you may return it in accordance with our Return Policy.

4. We have made every effort possible to ensure the colors are displayed as accurately as possible. NINE FIFTEEN declines any responsibility that, due to a particular configuration of a Consumer’s computer or malfunction, the colors of the products visualized on the website could appear to be slightly different from the original. If you have any questions about the color of an item please contact us prior to placing your order.

5. It is possible that small changes may have been made during the time between when a product was photographed to the production phase.

6. We may update and revise our product offering, and we may discontinue products at any time without notice. All pricing for the products is subject to change. For all of our prices and products, we reserve the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements, and other extenuating circumstances.

7. NINE FIFTEEN will not price match any sale or discount prices with any other retailers, including affiliates.

8. Products that are received damaged or become damaged by a manufacturing fault within six (6) months of purchase are considered faulty. Items that become damaged as a result of normal wear and tear are not considered to be faulty. NINE FIFTEEN will determine, in its sole judgment and discretion, whether the damage is as a result of normal wear and tear or some other reason. Damaged or faulty products will be replaced or repaired, where possible and subject to availability. If a product cannot be replaced or repaired, you are entitled to a refund within the six (6) month period.

4. Order Acceptance and Cancellation

1. Your receipt of an electronic, or other form of, order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason, whether or not you have been charged. If applicable, your order will be refunded in the original form of payment. If your credit card has been charged and your order is canceled by NINE FIFTEEN, we will immediately issue a refund to you in the amount of the charge and notify you that your order was canceled.

2. Canceling an order - Based on the nature of MADE-TO-ORDER, you may cancel your order within 7 days of placing the order, for a full refund. Canceling an order any time after 7 days from placing the order, will result in a 30% charge.

5. Shipping, Taxes, and International Duties

1. NINE FIFTEEN is not responsible for lost or stolen packages or unexpected shipping delays caused by circumstances such as severe weather or natural disasters. Similarly, we are not responsible for unexpected shipping delays caused by circumstances related to the courier itself, such as clearance delays. In cases such as these, please directly contact the courier with any inquiries about the status of your package or contact NINE FIFTEEN, and we'll try to help. 

2. In the case that the courier is unable to deliver a package due to an incorrect address entered by the customer, the Consumer’s refusal to pay duties, multiple failed attempts to reach the Consumer at point of delivery, or otherwise, NINE FIFTEEN is not responsible for payment of return shipping costs levied by the courier. Similarly, NINE FIFTEEN is not responsible for the payment of re-shipping merchandise to the Consumer. In cases such as these, the Consumer is responsible for all shipping costs associated with returned packages due to failed delivery.

3. Please note that the shipping time frame, if provided, may vary. The shipping time frame is contingent upon payment transaction approval and may be delayed should we experience difficulties in obtaining authorization. NINE FIFTEEN is not responsible for any international shipping delays caused by the customs clearance process.

4. The costs of shipping and any import taxes, and duties paid are non-refundable.

5. VAT will be charged on orders shipped to EU member countries.

6. Eventual additional local taxes, including Customs import, are NOT included, and are the Client’s responsibility. As the recipient, you will be responsible and liable for all, should they be levied by the country you are shipping to. Payment of these amounts will be necessary to release your order from customs on arrival.

7. NINE FIFTEEN ships worldwide, but does not deliver to P.O. Boxes.

8. All orders are dispatched with ‘No Signature Required’ and may be left at a residence deemed safe by the delivery company. NINE FIFTEEN is not responsible for any loss or liability or damage that may result from leaving your package at the shipping address without a signature. If you prefer to have your order shipped with ‘Signature Required’ please contact us, so that we may make arrangements.

9. All shipments destined for countries outside the European Union, as required by Customs regulations, are accompanied by an invoice declaring the value of the merchandise.

10. NINE FIFTEEN does not have does NOT have offices outside of Italy to import orders, and can neither collect nor pay Use Tax or Sales Tax on the Client’s behalf. Other countries may require citizens to pay these taxes for online purchases at the end of the fiscal year. NINE FIFTEEN cannot be held responsible for these taxes under any circumstances. Therefore the Client is considered the final importer. 

11. If the package is not successfully delivered to the Client’s address due to a lack of cooperation from the Client (wrong telephone number, wrong address, absent at address, non-compliance with import regulations), the package may risk being sent back to Italy at the Client’s expense including any import fees that may be assessed upon re-entry to Italy. These fees will be deducted from any eventual reimbursement.

6. Returns

1. Returns are accepted within 14 days from the date of delivery. Any return requests made outside of the 14-day return policy are at the discretion of NINE FIFTEEN, and may not be accepted. We reserve the right to refuse a return or exchange, if the merchandise in question does not meet our standards. 

2. Returns must be received in NEW and UNUSED condition, and with ALL original packaging, including dust bags, and other signature packaging materials, including NINE FIFTEEN hanging tags where provided. Any returned products which are damaged, do not include the packaging materials, are soiled, or altered may not be accepted, and may be sent back to the Consumer at their expense. Refunds will not be processed until the items are returned and inspected by NINE FIFTEEN.

3. Items sent back to us without first requesting a return will not be accepted.

4. All returns MUST be shipped via traceable and insured mail, along with any customs fees paid. In the event that you choose to forgo secured tracking, NINE FIFTEEN is not responsible for the package if it is lost or otherwise not received. 

5. Shipping is non-refundable except in cases where we have made a mistake.

6. Returns will be refunded to the original method of payment, where applicable, regardless of the card / account being removed from the site, expiring, or updating account information.

7. Due to the nature of made-to-order, there is a 30% return fee. NINE FIFTEEN holds the right to waive the fee, due to manufacturing fault, etc. 

7. Advertising and Trademark

1. NINE FIFTEEN is a registered trademark. The entire website is the exclusive propriety of NINE FIFTEEN company. No reproduction or representation (products, photos, graphical charter) can take place without the written and prior consent of NINE FIFTEEN company.

2. Images on NINE-FIFTEEN.NET belong to NINE FIFTEEN and any unauthorized use of these images without the express written consent of NINE FIFTEEN is forbidden.

8. Limitation of Liability

1. Entering this website, the User and NINE FIFTEEN agree that the laws and the regulations of the Italian State will enforce any questions pertinent to the use of the website. 

2. NINE FIFTEEN does not guarantee in any way that materials present on the website are in accordance with current regulations of other countries, and the access to those materials from places where the relative contents are illegal is expressly prohibited. Users who choose to enter this website from said locations do so at their own risk and are solely responsible to respect relative local laws.

3. Under EU regulation 434/2013, cross-border disputes can be settled out-of-court by using this online platform: http://ec.europa.eu/odr.

4. In no event shall we or our suppliers have any obligations or liabilities to you or any other person for loss of profits, for loss of business or use, or for incidental, punitive, special or consequential damages, whether based on contract, tort (including negligence), products liability, or any other theory or form of action, even if we have been advised of the possibility thereof, arising out of or in connection with the sale, delivery, or use of the products. Our sole and entire maximum liability (and the liability of our suppliers) for any reason, and your sole and exclusive remedy for any cause whatsoever, shall be limited to the actual amount paid by you for the products you have ordered through NINE-FIFTEEN.NET. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so the above limitations and exclusions may not apply to you to the extent such jurisdiction’s law is applicable to your purchase of products.
